Workshop on the National Credit Act during June 2008

In April 2007, we held a half day seminar on the National Credit Act at which our speakers gave a general overview of the Act and its compliance, the confusion and innacuracies that had arisen in its interpretation and how it affected the attorney's practice.
Some practitioners have expressed the opinion that the Seminar was too short to cover all the queries and that, now that the Act is fully operational, they would like a full day workshop. Some advocates have also expressed their keeness for such a workshop.
I have approached Justice College and a university professor to participate in the workshop and they have indicated their keeness but I would obviously like to gauge interest from practitioners before finalising the details. Please contact me on jtarica@global.co.za if you have any suggestions.

RANDBURG MAGISTRATES COURT - OTHER ISSUES

1. Motion Court - when filing your opposing affidavits, please indicate at the
top of your filing sheet the date when the matter is in roll to ensure that it
gets filed in the court file timeously.
2. Section 65 Court - This court has, with effect from the 7th March 2008, moved to Court 13 as this court has access to the cells to accomodate debtors who have
been arrested for contempt of court in terms of Section 65. Please ensure that
Your notices in future reflect the correct Court number.

TRIAL DATES IN RANDBURG

The waiting time for trial dates at the Randburg Magistrates Court is currently approximately 2 months. I attach hereto the new application form for a trial date to be used in Randburg. Hopefully, this form will appear in our next newsletter. Please note that if you require a specific trial date (e.g. Counsel or witnesses coming from afar) please motivate your request under the section for special consideration.

A trial date will not be allocated if there is no summons in the court file.

TWO INVITATIONS BY THE CITY OF JOHANNESBURG ON THE NEW VALUATION ROLL AND THE IMPLEMENTATION OF THE MUNICIPAL PROPERTY RATES ACT

Pending placing these invitations on the "Upcoming Events" on the main page of the website, I wish to advise practitioners of two invitations that have been extended to members of the JAA by the City of Johannesburg and which should be of great interest to practitioners, especially conveyancers.
1. The first invitation is a briefing on the new General Valuation Roll and the Draft Rates Policy for the City of Johannesburg. The briefing will be given by the Director Rates & Taxes (Erika Naude) and the Director of Valuation Services (Werner Sarvari). This briefing will take place on 6th November 2007 at 8h00 for 9h00 at the Southern Sun - Grayston, Corner Grayston & Rivonia Roads, Sandton. As seating is limited to 150 people, you are requested to RSVP by sending an email confirming your attendance to one of the following emails: melodys@joburg.org.za or nancyc@joburg.org.za or thomass@joburg.org.za
2. The second invitation is a special briefing on the implementation of the Municipal Property Rates ACt with a specific focus on the impact on Sectional Title property owners. Operator : "OK... you're .... Mr Sfiso Majola and you're calling from 17 Retief Street. Your home number is 011 403 2366, your office 011 764 2302 and your mobile is 082 266 2566. Which number are you calling from now Sir?
Customer: "Home! How did you get all my phone numbers?"
Operator : "We are connected to the System Sir."
Customer: "May I order your Seafood Pizza..."
Operator : "That's not a good idea Sir."
Customer: "How come?"
Operator : "According to your medical records, you have high blood pressure and even higher cholesterol levels, Sir."
Customer: "What?... What do you recommend then?"
Operator : "Try our Low Fat Hokkien Mee Pizza. You'll like it"
Customer: "How do you know for sure?"
Operator : "You borrowed a book entitled "Popular Hokkien Dishes" from the National Library last week Sir."
Customer: "OK I give up ... Give me three family sized ones then, how much will that cost?
Operator : "That should be enough for your family of 10, Sir. The total is R149.99!
Customer: "Can I pay by credit card?"
Operator : "I'm afraid you have to pay us cash, Sir. Your credit card is over the limit and you owe your bank R3720.55 since October last year. That's not including the late payment charges on your housing loan, Sir."
Customer: "I guess I have to run to the neighbourhood ATM and withdraw some cash before your guy arrives."
Operator : "You can't Sir. Based on the records, you've reached your daily limit on machine withdrawals today."
Customer: "Never mind just send the pizzas, I'll have the cash ready. How long is it gonna take anyway?"
Operator : "About 45 minutes Sir, but if you can't wait you can always come and collect it on your Green Double Cab ....."
Customer: "What!"
Operator : "According to the details in the system, you own a Nissan Double Cab, ... registration number NRB 132 GP ......"
Customer: " *'!^ *%^*%^I7*"
Operator : "Better watch your language Sir. Remember on the 15th July 1987? You were convicted for using abusive language to a policeman. I need not tell you what happened to you at Sun City Prison"
Customer: [Speechless]
Operator : "Is there anything else Sir?"
Customer: "Nothing ...... by the way ... aren't you giving me those 3 free bottles of cola as advertised?"
Operator : "We normally would Sir, but based on your records you're also diabetic ... "
Customer: "Please cancel the order, my wife will have to cook ...."
